Release of Liability

We Are Wildness
Updated: Sept. 2, 2017

I acknowledge that the activities and events facilitated, sponsored, or conducted by We Are Wildness may be hazardous and may result in personal injury, loss, or death.

With full knowledge of these risks, I hereby agree for myself and all of my family and heirs (1) to RELEASE We Are Wildness and its members, officers, trip coordinators or any representative from any liability, claims, or any causes of action that may arise out of or in connection with my participation in any activities (including travel to or from activity locations) sponsored or conducted by We Are Wildness, and (2) NOT TO SUE OR OTHERWISE MAKE ANY CLAIM against We Are Wildness, or any of its members, officers, trip coordinators or any representative that may arise out of or in connection with my participation in any activities sponsored or conducted by We Are Wildness.

I intend this RELEASE OF LIABILITY to be effective whether or not any loss, injury, or death results from the negligence of We Are Wildness or any of its members, officers, trip coordinators or any representatives. I understand that negligence means a failure to do an act that a reasonably careful person would do or the doing of an act that a reasonably careful person would not do, under the same or similar circumstances, to protect him/herself, or others from injury or death.

I agree to be solely responsible for my own safety while participating in the activities or events (including travel to/from activity locations) conducted or sponsored by We Are Wildness, and to take every precaution to provide for my own safety and well being while participating in such activities. I agree to follow the directions of the trip coordinator and to abide by the rules of the facilities used by me during the trip. I agree to abide by the restrictions placed on my participation in activities where alcoholic beverages are served.

IF YOU BRING A GUEST: I agree to provide a copy of this Liability Release Agreement to my guest and that, in bringing the guest to the event, I represent to We Are Wildness, its event leader(s) and members on the event that my guest has affirmatively agreed to the terms and provisions of this Liability Release Agreement, and that I will indemnify, defend, and hold We Are Wildness, its event leader(s), and members harmless from any claim within the nature and scope or acts or omissions covered by this Liability Release Agreement asserted by my guest.

  • Anyone who does not want to appear in an event photo that might be posted online or used in Adventure Group marketing materials (website, brochures and flyers, etc.) should notify persons on the event to exclude them from any photos.
  • By uploading a photo to We Are Wildness website, the photographer grants to We Are Wildness a non-exclusive right to make the photos available for viewing and downloading by our members and by use by We Are Wildness for its marketing and publicity materials.
  • Members should not redistribute photos without the permission of We Are Wildness Team and the photographer.
  • Because hikes and other group events take place in public settings, We Are Wildness is not liable for any loss of privacy arising from photography at any of our events.

We Are Wildness is pleased to be able to schedule events for its members. However, event leaders are amateur volunteers, not paid professionals. In addition, the nature of outdoor activities exposes you to hazards such as cliffs, fast moving water, injuries, temperature extremes, insects, poisonous plants, etc. As a result, you need to take responsibility for your own safety while participating in any event that is coordinated by the group. We do have some reasonable safety guidelines that members are asked to adhere to in order to help insure the safety and enjoyment of the events. However, you should familiarize yourself with appropriate safety guidelines, which are available from numerous sources such as the National Park Service, retail stores like REI and MEC, and other similar organizations. In addition, you should bring any equipment necessary to ensure your personal safety and comfort when attending any We Are Wildness event.
